Agreement
These terms govern your use of Ainomiq Reply, operated by Ainomiq B.V. (Brederodestraat 10 B, 1054 MT Amsterdam, KvK 42032616, VAT NL869396559B01). By creating an account or connecting a WhatsApp number, you agree to them. If you use the service on behalf of a business, you confirm you are authorized to do so.
The service
Ainomiq Reply connects your own WhatsApp Business number and answers messages automatically, grounded in the knowledge you provide and constrained by the rules you set. A human on your team can take over any conversation at any time. Replies are sent from your own number, in your own brand voice.
Your responsibilities
You are responsible for the knowledge and rules you configure, for having a lawful basis to message your contacts, and for complying with WhatsApp's and Meta's policies. Do not use the service for spam, unlawful content, or anything that violates those policies.
Data roles
For the messages handled through your number, you are the data controller and Ainomiq B.V. is the processor acting on your instructions. We process that data only to provide the service, as described in our Privacy Policy. A Data Processing Agreement (DPA) and our current subprocessor list are available on request at privacy@ainomiq.com.
Automated replies
The assistant generates replies automatically and sends them from your number. You are responsible for the content it sends, for telling the people you message that an automated assistant may respond, and for obtaining any consent your local law requires.
Plans, payment, and renewal
The service requires a paid monthly plan. Each plan includes a monthly bundle of AI conversations (a conversation counts once per calendar month, on the assistant's first reply in it). If you use more than your bundle, the assistant keeps working and extra conversations are added automatically at EUR 30 per 250, charged on your next invoice. Prices exclude VAT; VAT is calculated at checkout. Payments and invoices are handled by Stripe. Subscriptions renew monthly until cancelled. You can change or cancel your plan at any time in Settings; cancellation takes effect at the end of the paid period and amounts already paid are not refunded. If a payment fails, we notify you and the assistant keeps answering for 7 days; after that it pauses until payment succeeds. We may change prices with at least 30 days notice; changes apply from your next renewal.
Availability
We work to keep the service reliable but provide it on an as-is basis without a guaranteed uptime. We may update or improve features over time. We will give reasonable notice of material changes that affect you.
Liability
To the extent permitted by law, Ainomiq B.V. is not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited under applicable law.
Termination
You can stop using the service and delete your data at any time (see Data Deletion). We may suspend accounts that breach these terms or Meta's policies.
Governing law
These terms are governed by the laws of the Netherlands. Disputes are subject to the competent courts in the Netherlands.
